1. Who we are
Spoken Over Me (the "Service") is operated by Holly Teegarden, an individual based in Pennsylvania, United States ("we", "us", "our"). By creating an account or using the Service you ("you") enter into this agreement with us.
2. Acceptance of these terms
By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service. You confirm that you are at least 13 years old (or the minimum digital-consent age in your jurisdiction) and have authority to enter this agreement.
3. The Service
Spoken Over Me (the "Service") is a private faith-journaling application with optional Bible study frameworks that helps you understand and apply Scripture to your every day life (SOAP, FAITH, KNOW, WORD, Post It On My Heart), scripture features, and an optional small-group add-on that enables shared prayer requests and group features. Features available to you depend on your plan.
4. Your account
- You must provide accurate information and keep it current.
- You are responsible for safeguarding your login credentials and for all activity under your account.
- You must notify us promptly of any unauthorized use of your account.
5. Acceptable use
You agree not to:
- Use the Service unlawfully, fraudulently, or to send spam;
- Infringe anyone's intellectual property or privacy rights;
- Probe, scan, scrape, or interfere with the security or integrity of the Service or transmit malware;
- Post content that is hateful, harassing, sexually explicit, exploitative of minors, or that promotes violence;
- Resell, redistribute, or commercially exploit the Service without our written permission;
- Reverse engineer or attempt to circumvent any technical limitations of the Service.
6. Your content
You retain ownership of journal entries, prayers, notes, and other content you create ("Your Content"). You grant us a limited, non-exclusive, worldwide license to host, store, back up, and process Your Content solely to operate and provide the Service to you. When you share prayer requests or other content with a small group, you grant other group members the right to view that content for the purpose of praying with you.
7. Our intellectual property
The Service, including its software, design, branding, templates, scripture-prompt curation, and documentation, is owned by us and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms and your selected plan.
8. Payment, subscriptions, and billing
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms.
Subscriptions renew automatically for the term you selected (monthly or yearly) until canceled. When you cancel, your paid features remain available until the end of your current billing period; you will not be charged again.
9. Refunds
See our Refund Policy.
10. Service availability
We work to keep the Service running reliably, but we do not guarantee that it will be uninterrupted, error-free, or available at all times. We may add, change, or remove features.
11. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay, create security or fraud risk for us or other users, or repeatedly violate our acceptable-use rules. You may stop using the Service at any time by canceling your subscription and/or deleting your account.
12. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. The Service is a journaling tool and is not a substitute for pastoral counsel, medical, mental-health, or professional advice.
13. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses. Our aggregate liability arising out of or relating to the Service will not exceed the amounts you paid to us in the 12 months preceding the claim. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence where such limitation is not permitted by law.
14. Indemnity
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from Your Content, your use of the Service, or your violation of these Terms.
15. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to its conflict-of-laws principles. The state and federal courts located in Pennsylvania will have exclusive jurisdiction over any dispute, except where applicable consumer-protection law gives you the right to bring proceedings in your local courts.
16. Changes to these Terms
We may update these Terms from time to time. If the changes are material, we will notify you (for example by email or in-app notice). Continued use of the Service after the changes take effect constitutes acceptance.
